User Terms and Conditions

Welcome to PLAT-DEL®, a service offered by ZENOF LOGISTICS (“PLAT-DEL®,” “we,” “us,” or “our”). By accessing or using our marketplace super app, including instant orders, cross-border marketplace, and ride-hailing services, you agree to be bound by these User Terms and Conditions (“Terms”). If you do not agree to these Terms, do not use our services.

1. Acceptance of Terms

By creating an account or using any of our services, you agree to comply with and be bound by these Terms, our Privacy Policy, and any other policies or guidelines applicable to our services. These Terms apply to all users of the services, including without limitation users who are vendors, customers, merchants, contributors of content, information, and other materials or services.

2. Services

PLAT-DEL® provides various services, including but not limited to:

• Instant orders for products and services.
• A cross-border marketplace for buying and selling goods.
• Ride-hailing services.

3. Eligibility

With the exception of parent-controlled dependent accounts (Accounts sublet by parents/guardians whose terms they assent to), you must be at least 18 years old to use our services. 

By using our services, you represent and warrant that you have the right, authority, and capacity to enter into these Terms and to abide by all of the terms and conditions herein.

4. Account Registration

To access certain features of our services, you may be required to register for an account. When you register for an account, you must provide accurate and complete information and keep your account information updated. 

You are solely responsible for the activity that occurs on your account and for keeping your account password, OTP, PIN or other security features updated from time to time secure. You must notify us immediately of any breach of security or unauthorized use of your account.

5. User Conduct

You agree not to engage in any of the following prohibited activities:

• Violating any applicable law, statute, ordinance, or regulation.
• Engaging in fraudulent or deceptive practices.
• Interfering with or disrupting the integrity or performance of our services.
• Attempting to gain unauthorized access to our services or related systems or networks.
• Posting or transmitting any content that is defamatory, obscene, pornographic, abusive, or offensive.

6. Orders and Payments

All orders placed through our app are subject to acceptance by us. We may, in our sole discretion, refuse or cancel any order for any or no reason. 

Prices and availability of products and services are subject to change without notice. Payments for orders must be made through the payment methods provided in the app.

7. Cross-Border Marketplace

Our cross-border marketplace allows you to buy and sell goods internationally. By using this feature, you agree to comply with all applicable import and export control laws and regulations. 

You are responsible for ensuring that your transactions are lawful in both your jurisdiction and the jurisdiction of the buyer or seller.

8. Ride-Hailing Services

Our ride-hailing services connect you with third-party drivers. We do not provide transportation services ourselves and are not responsible for the acts or omissions of drivers. 

By using our ride-hailing services, you agree to pay the fare displayed at the time of booking. Fares are subject to change based on factors such as distance, time, and demand.

9. Intellectual Property

All content and materials on our app, including text, graphics, logos, icons, images, and software, are the property of PLAT-DEL® or its licensors and are protected by copyright, trademark, and other intellectual property laws. 

You may not use, reproduce, distribute, or create derivative works based on any content or materials on our app without our prior written permission.

10. Limitation of Liability

To the fullest extent permitted by law, PLAT-DEL® shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

• Your use of or inability to use our services.
• Any unauthorized access to or use of our servers and/or any personal information stored therein.
• Any interruption or cessation of transmission to or from our services.
• Any bugs, viruses, trojan horses, or the like that may be transmitted to or through our services by any third party.
• Any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available through the services.

11. Indemnification

You agree to indemnify and hold PLAT-DEL® and its officers, directors, employees, and agents harmless from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the services or your violation of these Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Kenya, without regard to its conflict of law principles.

13. Changes to Terms

We reserve the right, in our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 10 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our services after those revisions become effective, you agree to be bound by the revised terms.

14. Termination

We may terminate or suspend your account and access to our services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the services will immediately cease.
